- Civil law is a private law that deals with relationships between private individuals and can be separated into contract and tort law. Tort law includes being subject to action in civil court which can result in civil trial for plaintiff to get compensation. There is intentional and unintentional tort. Intentional is assault, battery, defamation of character, fraud, and invasion of privacy. If a nurse does not keep confidentiality of patient, threatens patient, does not get permission to perform assessment or exam on the patient this can occur. For a nurse, an unintentional tort would be malpractice which can occur if the nurse neglects care of patient. However, four elements must be met for malpractice to be charged. This includes duty to plaintiff, failure to meet standard of care, or breach of duty, omission, causation, and damages to plaintiff/patient. If malpractice is proven than money is given to patient by the provider.
